The Cosmetic Stop User Agreement.
The below information will describe specific user agreement terms
and conditions. Thank you, for taking the time to read our terms and
conditions for using the Cosmetic Stop auction site. By
reading the following information you will find that our policies
and terms are simple and easy to understand. You must read the
following, agree with and accept all terms, and conditions contained
with the Cosmetic Stop.
1. Eligibility.
Our services are not available to minors or to suspended members. If you
do not qualify then do not use our service. Your Cosmetic Stop
account can not be sold or transferred to other parties. If you
register under a business entity, then you must have the authority
to bind the entity to our agreement. The service that we provide is
exclusively available to those who can form legally binding
contracts under applicable law.
2. Fees.
First of all its free to buy and join! Our only fees are for registering
an item to sell on our site. When you list your item on the site
block, you will have the opportunity to review and accept our fees
before it is listed. Our fees are effective once you have submitted
your item. All fees are in U.S. dollars unless otherwise stated. You
are responsible for paying all fees associated with our site and
applicable taxes. We may choose to temporarily change our fees and
policies from time to time, however they will be in effect with a 30
day notice. These changes will be made through announcements via our
registration board.
3. Bidding & Purchasing.
The buyer or the awarded bid winner is obligated to purchase the item
from the seller. By bidding on a item you agree to be bound by the
conditions and terms of sale so long as those conditions of sale are
within the law. You may retract a bid before the bidding has closed.
Changes in the item that may have occurred after you bid or
typographical error are the only allowed reasons for retracting
bids. However, these bidders must retract prior to the end of the
auction or they will resume the award winner.
4. Listing Your Item & Selling.
Your Item Listing your item. All of your items that you list must be in
the correct category. You must be legally able to sell your item
that you list. You can only include the description of your item or
items, pictures,artistic graphics, and other information pertinent
to your item for sell. Each listing is only approved for one item,
except in the case of a dutch auction, where a seller can list
multiple identical items. You are obligated to sell your items. If
you receive at least one bid at or above your listed starting price
or at or above your set price you are obligated to complete the
transaction with the award winning bidder or buyer at the end of the
auction. Only if the purchaser or buyer fails to comply with the
terms of your listed information on payment instructions or payment
methods and if you can not authenticate who the buyer is through
your own means, then you may not be obligated to sell your item. The
Cosmetic Stop is not responsible in any way or form in assisting in
transactions. The buyer and seller accepts all responsibilities for
transactions and payment methods for the item or items sold. You may
not influence in an unfair or fraudulent way as a buyer or seller,or
user of this site, with any item,or items price, user listing, or
transactions.
5. Fraud.
We will terminate your account without limiting other remedies if we
suspect that by conviction, investigation, or other means have acted
in a fraudulent way towards are site.
6. The Cosmetic Stop Auction Center Is Simply Not An Auction Or
Auctioneer.
We are what is called a venue, just a site to offer others to
browse,sell,and buy their items We are not an auction or auctioneer.
The Cosmetic Stop simply provides a place for you to browse,
sell, or buy items that are up for sale in many different ways
anywhere, anyplace. We have no control over the actual transactions
between buyers and sellers. We take no responsibility over the
actual transactions between buyers and sellers. We can not be liable
that a buyer or seller will complete their payments, or
transactions. We have no control or responsibility over the outcome
of the state, quality, safety, or legality of the item, or items
that are on our site, or the validity, and truth of any listing, or
listings.
7. Verifying Identification.
Registration on our site can be found under the registration file icon
on our home page. Determining the true identity of a buyer or
seller, or user is hard to do on the internet. We can not confirm
each users identification on our site. To help out with user
identity we have created a simple way of determining who you may be
interacting with via our customers page or you might want to
communicate through our site. Communicating directly is encouraged
to better enhance communication. A third party escrow service is
also another means.
8. Release.
The Cosmetic Stop is a venue. Since we are a venue if you have a
dispute with a user or users, you release the Cosmetic Stop
and our agents, officers, directors, subsidiaries, joint ventures,
and all employees from claims, demands, damages, actual and
consequential of any kind of nature, that is known, and unknown,
suspected and unsuspected, disclosed and undisclosed, arising out or
in any way connected with these such disputes. If you reside in
California as a resident, then you waive California civil code 1542,
that states " a general release does not extend claims which the
creditor does not know or suspect to exist in his favor at the time
of executing the release, which if known by him must have materially
affected his settlement with the debtor."
9. The Control of Information.
We do not provide control of information from others or other users on
our site. There is a possibility that you may find information from
others may be incorrect, harmful, offensive, or deceptive. Make a
note that you may be dealing with a person who is under age or
acting under false pretenses. We encourage caution and the practice
of good moral faith. There may also be risks dealing with
international trade.
10. Your Identity and Information.
We act as a neutral medium for your information that is sent through our
site. You are the only one responsible for your information. Any
information you provide to us or other users in our system, listing,
bidding, buying, registration, customers page, or through email is
considered your information. The information you provide and all
listed items you provide is restricted and shall not be: incorrect,
false, stolen, fake, fraudulent, counterfeit, discriminatory,
infringe on a copyright, trademark, patent, others proprietary
rights, or violate rights of privacy, publicity, violate any law,
ordinance, regulation, statute, (including, but not limited to,
those governing export control, consumer protection, unfair
competition, antidiscrimination or false advertising) in any way
slander, unlawfully threatening or harassing, may not contain any
computer viruses, or other computer program routines that may
damage, interfere with, intercept any system data or information,
create a liability for us, include goods that are prohibited, have
other items that are identical that are listed in our auction that
is priced lower than your items set amount bid or starting bid
amount, and you may not list any item on our site or transaction
used using our service that by paying us the listing fees might
possibly cause us to infringe or brake any applicable law,
regulation, ordinance, statute, that violates the law. We will only
use your information with regards to our policy. You agree to grant
us a royalty-free, non-exclusive, perpetual, worldwide, unalterable,
through numerous tiers, right to exercise the copyright, publicity,
and database rights, but no others, that is listed in your
information through the media known or unknown, with respect to your
information according to our policies.
11. Customers Page.
Designed to help assist in learning more about the identities of our
users. You can not be deceitful, falsify, or exhibit poor faith, and
judgment towards other users on the customers page. You are agreeing
that you are receiving feedback sent by other users who have
conducted either buying or selling with you. The only comments you
will receive are from our users. You can not take action against our
customers page that might undermine the quality or state of the
page. We will exercise our right to pull you from our site with
regards to bad ratings from our users. A number of 2 bad ratings
from our users customers page within a calendar year is enough to
suspend, enable, or terminate your user status. The customers page
is used to help with and facilitate between buyers and sellers. The
information provided on this page is for the sole use of our users
and will not be used outside of our site for other site purposes. We
will terminate and revoke your user membership or suspend you if you
break or breach this agreement, and the documents it incorporates if
you may cause us financial loss, a legal liability to us, or our
users, unable to verify your information clearly.
12. Users Privacy Protection.
Users privacy is important to us. We will not give your information to a
third party without written consent, nor will we sell or rent it. If
you disagree with the transfer of your information to us please do
not use our site.
13. You Will Comply With All Domestic And International Laws.
Under all domestic and international laws you will also comply with all
statutes, regulations, and ordinances with the use of our site. We
are independent contractors and we do not intend to create any joint
venture, partnership, or franchise with our users. You agree to hold
us harmless against any claim or demand including any attorney fees
made by a third party, or the documents it incorporates by
reference, or the violation of any law, or the rights of a third
party.
14. There Is No Warranty.
Our web site and our suppliers provide no warranties of merchantability
expressed or implied. Our services and web site is "as is" with no
warranties of merchantability expressed or implied without any
warranty or statutory. We our employees, subsidiaries, suppliers
disclaim any implied warranties of merchantability, fitness, and
title for a particular purpose, and non-infringement. Liability.
We are not liable for any loss profits. We are not liable for any
loss profits concerning any unique consequential, or incidental
damages arising from the use of our site including negligence. We
are not liable in any circumstance in the event of loss profits with
any connection to our site.
15. We Encourage Good Faith.
We encourage good faith, moral conduct, sincerity, and honesty with the
use of our site.
16. Taxes.
There is taxes on everything you sell. As a seller, you should be
concerned about income and sales tax. The Cosmetic Stop advises you
consult a tax consultant. Contacting a tax consultant expert can
help answer questions you might have.
17. Feedback Removal.
The Cosmetic Stop users are cautioned to use good conduct and judgement
when leaving feedback. You could be found liable for damages to a
users reputation if a court finds you liable or defamation is
involved. Under the Communications Decency Act, the Cosmetic Stop is
not legally responsible for the remarks that users post on its site,
even if they are defamatory. The feedback on this site has
absolutely no connection with the Cosmetic Stop.
18. Fraud Protection.
We encourage safe buying and selling with our users. We encourage our
buyers to follow these steps to avoid faulty transactions:
a. Communication via the telephone or via email is encouraged. Most
issues can be solved through conversation.
b. Contact your credit card company. Many credit cards offer full
online protection. You can also use a online payment service.
c. If your item is lost or damaged when shipping, contact your shipper.
19. General Agreement.
The agreement shall be governed with all respects of the laws of the
state of Colorado. If any portion of this agreement is to be invalid
or unenforceable, such provision will be struck and remaining
provisions will be enforced. If we fail to act with regards to a
breach with you or another party does not waive our rights to act
accordingly to subsequent and similar breaches. This agreement
constitutes the whole understanding between us with respect to the
subject matter hereof. Fee's and services, with acknowledging fee's
owed to us for our services, release, license, access and
interference, arbitration, liability, protection from loss
(indemnity) and arbitration will overcome any expiration, or
termination of this agreement.
20. Services Offered.
The services of this site are brought to you by Cosmetic Stop.
